PRIVACY 

NEW PRIVACY STATEMENT - Southwest GS ENT Group, LLC (SWGS) Privacy Statement 

As of October 23, 2018, it is in effect.

1. SWGS Introduction

The terms and acronyms used in this Privacy Policy are the same as those used in our Terms of Service document. This Privacy Policy explains and controls how we collect, utilize, and keep your personal data. 

Depending on whether information may identify you as a particular person, information about you can be classified into personally identifiable and non-personally identifiable information. "Personal data" refers to information that may be used to identify a person.

The following terminology and abbreviations, in addition to the definitions specified in the Terms, shall have the meanings indicated herein: 

An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to that natural person's physical, physiological, genetic, mental, economic, cultural, or social identity. 

Any operation or set of operations performed on personal data or sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment or combination, restriction, erasure, or destruction is referred to as "processing." 

A natural or legal person, governmental authority, agency, or other organization that processes personal data on SWGS's behalf is referred to as a "processor." 

A "personal data breach" is defined as a security breach that results in the unintentional or illegal destruction, loss, modification, unauthorized disclosure, or access to personal data that has been sent, stored, or otherwise processed. 

 

2. SWGS Personal information on we handle as an organization. 

 

We may handle the following personal data through your contact with the Services or with us directly: 

• Personal information (such as first name, last name, username, or similar identifier) 

• Contact information (such as billing address, email address, and telephone numbers) 

• Financial information (such as bank account and payment card details) 

• Information on transactions (such as details of payments and services purchased) 

• Data from the commercial sector (such as company name, business purpose, and requirements for video generation) 

• Information about your profile (such as username and password, preferences, feedback, and survey responses) 

• Information on use (such as information about how our website, products, and services are used) 

• Information on marketing (such as marketing and communication preferences) 

• Audio/Video information (such as content uploaded as a data source for video generation) 

• Technical information (such as an IP address, login credentials, browser, time zone setting and location, and the operating system used for access) 

• Any other information you want to provide. 

When you engage with the Services, register and customize an account, or contact us, we may gather personal data. 

 

3. SWGS the purposes for which personal data maybe used within this organization.

4. SWGS legal foundation for processing data

• Processing is required to carry out our duties under the Agreements;
• Processing is required to comply with legal requirements; and

We may use your email address to notify you of service changes, introduce you to new services, or offer you general information about our services. We have a genuine interest in keeping you up to date on the Services and marketing new Services that we think you would find useful. By clicking the unsubscribe link in the email, you may unsubscribe from these newsletters at any time. We will not send you promotional emails for third-party services based on genuine interest. 

 

When you visit the Services, we may automatically process your IP address and other technical data. This is because we have a legitimate interest in protecting the security and integrity of our Services, and by collecting technical data, we can scan it and detect harmful indicators such as a high number of password failures, exploit hunting, and other similar activities. 

 

We may use third-party analytics technologies to collect information about how you use the Services and interact with the website. We handle this data because it is in our legitimate interest to analyze the functioning of the Services and to update them. We try to keep the quantity of personal data in such information to a minimum and anonymize it wherever feasible. Session data is anonymized and exclusively used for research purposes to enhance and modify our services. Third-party programs are unable to link session data to a single User. 

 

We may use the information you supplied to create a movie for internal research purposes or to enhance our Services or other SWGS technologies. Our genuine interest in enhancing the Services and creating new technology is what we depend on. Such content processing is common with services that rely on continuous study and development via their usage.

If you do not give required personal data, certain Services may be unavailable to you; for example, you will be unable to register for an account if you do not supply your name and email address. Furthermore, certain Services may need extra information, which will be provided when the respective Service is requested.

We may keep track of any queries, concerns, or praises you send us, as well as our responses. We will gather whatever information you want to share whenever you contact us. This information will be stored and used only to reply to your questions.

We utilize the information we gather for internal and marketing reasons only, as required by the nature of the Services, and solely in compliance with this Privacy Policy. 6. SWGS Children's privacy

 

Our Services are designed for a broad audience and do not specifically target children under the age of 16 ("minors"). We never knowingly collect or solicit information from children, and we never allow minors to use the Service.

7. SWGS Third-party services and cookies, which may be used on this site

8. SWGS Personal data storage and transmission, which may or may not be used on this site.

Personal information will be kept on secure servers that are monitored and maintained to provide adequate privacy protection. We may store or transmit information about Users to processors outside of the United States, provided that such processors use adequate and appropriate protections to protect personal information.

If you create an account with us, we will keep your personal information for as long as your account is active. We may preserve your personal information in our backup for up to a year after you deactivate your account in order to maintain the integrity of our backup storage data and respond to any appeals or requests related to your purchases. We may keep certain personal data for longer periods of time if required by law or if we have a legitimate purpose in doing so.

9. SWGS - Rights of our Customers

We shall treat all personal data in compliance with GDPR principles, with particular attention to Users' rights, including the right to:

• Request access to any data kept about them by SWGS in a generally used and machine-readable format in certain situations.

• Freely transmit their personal data to another data controller when it is processed on the basis of permission or contractual performance, unless doing so would jeopardize the rights or freedoms of other Users or others, such as trade secrets or intellectual property.

• In some instances, they may stop the processing of their personal data or withdraw their permission at any time. 

• Request that incorrect personal data be corrected. 

• Erasure of their personal data if the data is no longer needed for the original purpose or if the User has withdrawn permission and no other permissible processing grounds apply. 

• In some instances, object to the processing of their personal data.

Be alerted when their personal data is subject to automated decision-making, i.e. profiling, including the logic involved, the importance and expected consequences of such processing for the data subject, and to object to profiling in specific instances.

When you request that we correct, remove, or limit the processing of your personal data (excluding data required by legal duties), we may be obligated to tell certain third parties to whom such personal data has been disclosed of your request.

If you believe that the processing of personal data about you violates the FTC - Federal Trade Commission, you may file a complaint with the FTC @ https://www.ftc.gov, without prejudice to any other administrative or judicial remedies.

10. Legal Disputes

​

Legal disputes Arbitration, on the other hand, is a private process in which both parties agree that an arbitrator (a neutral third party) will render a binding decision. If any legal matter can’t be resolved between Southwest GS ENT Group, LLC (SWGS) and the Customer, all court proceedings will take place in Houston, TX in Harris County Courts. SWGS representatives, including the owners have the right to defend themselves without legal representation, but if legal representation is needed by SWGS, the Customer agree to pay any and all legal fees incurred by SWGS involved in any law suits and/or litigation on matters, which can’t be resolved via arbitration.

This Disclaimers protects Southwest GS ENT Group, LLC business against any and all legal liability by saying that, SWGS or owners/represenatives, won't be held responsible for how customers (people/businesses/end-users) use SWGS's site. SWGS assumes no responsibility or liability for any errors or omissions in the content of this site. The information contained in this site is provided on an "as is" basis with no guarantees of completeness, accuracy, usefulness or timeliness.

11. SWGS modifications to our Privacy Policy

At any moment, we retain the right to amend our Privacy Policy. The most recent version of the Privacy Policy may be seen on the website, with the effective date noted in the title. You should review our Privacy Policy on a regular basis.
